The service

Sportfolios provides hosted photo galleries, automated organisation of sports photographs using jersey numbers and optional player references, customer selection tools, a digital shop and protected file delivery. Features vary by plan.

Your content, your rights

You keep all rights in the photographs you upload. You grant Sportfolios only the licence needed to store, process, generate derivatives of and deliver them on your instruction. Uploading or publishing a gallery does not grant us permission to use its photographs for marketing. Any marketing use requires a separate permission covering the intended use and the necessary rights of the people shown. Sportfolios does not use uploaded photographs to train a general model.

App licence and photo licences

For the iOS and iPadOS application distributed through Apple's App Store, Apple's Standard Licensed Application End User License Agreement applies to the app software. These service terms cover the Sportfolios service and do not replace that agreement or override mandatory consumer rights.

For the Android application, Sportfolios grants you a non-exclusive right to install and use the app for its intended purposes on devices you own or are authorised to use, subject to applicable Google Play terms. You may not redistribute the app as your own, bypass access controls or misuse another person's content. Statutory rights, including permitted interoperability and software analysis, are unaffected.

The app licence does not grant a licence to every photograph shown in it. Each photo offer specifies its permitted use; copyright remains with the respective rights holder. Free access or a download does not by itself grant unlimited commercial reuse.

Your responsibilities

By uploading photographs you confirm that:

• you hold the rights necessary to upload and distribute them,
• you have obtained any consent required from the people shown, including guardian consent for minors,
• before enabling reference-based biometric player recognition, you have established and documented the legal basis required for every affected player,
• the roster data you import is accurate and you are entitled to process it,
• you will not upload unlawful content.

Plans, limits and billing

Storage, gallery and recognition limits are stated per plan and enforced server-side. Subscriptions renew until cancelled and are billed in advance under the applicable plan terms. Digital photo purchases offered inside the iOS app use Apple's in-app purchase system. Applicable web and physical-product checkout use the payment provider identified at checkout, such as Stripe. Provider charges and platform terms may differ between checkout methods.

Photo purchases and delivery

Before a photo purchase, the checkout identifies the product, selected photographs, applicable licence and price. In the iOS app, the price shown by Apple's purchase system is the price for that in-app product. A licence purchase does not transfer ownership of the photographer's copyright; the permitted use is determined by the selected licence.

For an iOS digital purchase, Sportfolios verifies Apple's signed transaction before granting access to the selected files. A payment callback alone is not treated as completed delivery. Sign in with the same account to access the purchase history that Sportfolios records for that purchase. Contact support if a verified purchase has not been delivered; do not make another purchase merely to retry delivery.

Refunds and revoked transactions are handled through the relevant payment provider and applicable law. A verified Apple refund or revocation can invalidate the associated download access. Free-download galleries follow the photographer's access settings and do not require a purchase when free downloads have been enabled.

Consumer rights

Mandatory consumer rights, including remedies for defective digital products and applicable withdrawal rights, remain unaffected. An immediate download does not on its own waive a statutory withdrawal right. Where the law permits that right to expire for digital content, the required separate express consent, acknowledgement and contract confirmation must be obtained; acceptance of these general terms is not a substitute.

Contact support about non-delivery, an incorrect charge or a defective file. The refund process of a store or payment provider does not exclude statutory claims against the responsible contracting party.

Reporting content and local hiding

Do not upload unlawful, abusive or infringing material. Customers can report an accessible gallery or photo through the mobile reporting control, or write to diego@rodriguez-web.de with the gallery link and relevant details. Reports enter a review queue; sending a report does not automatically remove the content. We may restrict or remove content or suspend access where a breach requires action.

Hiding a photographer in the mobile app hides that photographer's galleries on the current device. It is not a server-wide block or an account-deletion request and does not itself cancel an existing purchase. Contact support for content removal, rights requests or help with a purchase.

Availability

We aim for high availability but do not warrant uninterrupted service. Planned maintenance is announced where practical. Recognition is an aid, not a guarantee: assignments should be reviewed before a gallery reaches families.

Termination

You may cancel a subscription under its applicable plan terms; cancelling renewal and deleting an account are separate actions. We may suspend an account for non-payment or for a serious breach of these terms.

The mobile account settings let you request account deletion. Export photographs and information you want to keep before confirming it: deleting a sole-owned workspace removes its private media and is not a 30-day export grace period. Shared-workspace content remains with that workspace; ownership must be transferred first where other active members would otherwise be left without an owner. Records required for accounting, consent, security or evidence of the deletion process may remain for the applicable retention period.

Liability

Liability is limited to the extent permitted by German law. Nothing here limits liability for intent, gross negligence, or injury to life, body or health.

Governing law

German law applies, without depriving consumers of mandatory protections applicable in their country of habitual residence. Statutory consumer jurisdiction rights remain unaffected. An exclusive place of jurisdiction at the operator's registered seat applies only where such an agreement is legally permitted, in particular for qualifying business customers; it is not imposed on consumers generally.
