Terms of service

These terms govern the use of Sportfolios by photographers, studios, clubs and their customers.

The service

Sportfolios provides hosted photo galleries, automated organisation of sports photographs using jersey numbers and optional player references, customer selection tools, a digital shop and protected file delivery. Features vary by plan.

Your content, your rights

You keep all rights in the photographs you upload. You grant Sportfolios only the licence needed to store, process, generate derivatives of and deliver them on your instruction. We do not use your photographs for marketing, and we do not use them to train models.

Your responsibilities

By uploading photographs you confirm that:

  • you hold the rights necessary to upload and distribute them,
  • you have obtained any consent required from the people shown, including guardian consent for minors,
  • before enabling reference-based biometric player recognition, you have established and documented the legal basis required for every affected player,
  • the roster data you import is accurate and you are entitled to process it,
  • you will not upload unlawful content.

Plans, limits and billing

Storage, gallery and recognition limits are stated per plan and enforced server-side. Subscriptions renew until cancelled and are billed in advance. Sales made through the shop are settled through Stripe; Sportfolios does not take a commission on sales.

Availability

We aim for high availability but do not warrant uninterrupted service. Planned maintenance is announced where practical. Recognition is an aid, not a guarantee: assignments should be reviewed before a gallery reaches families.

Termination

You may cancel at any time; the subscription runs to the end of the paid period. We may suspend an account for non-payment or for a serious breach of these terms. On termination you may export your data for 30 days before it is deleted.

Liability

Liability is limited to the extent permitted by German law. Nothing here limits liability for intent, gross negligence, or injury to life, body or health.

Governing law

German law applies. Place of jurisdiction is the operator’s registered seat.
